The Claude usage-limit lawsuits

Two proposed class actions, one court, nothing decided yet.

Last updated , checked against the court dockets.

Summary

Two separate proposed class actions in federal court in San Francisco say paid Claude plans delivered less usage than Anthropic promised. Anthropic has asked the court to dismiss both. There is no ruling, no certified class and no settlement.

There is nothing to sign up for: no settlement, refund or claim form exists. Be wary of any site that asks for your Claude login to “join”.

Kahn v. Anthropic PBC

N.D. Cal. · No. 3:26-cv-05763-AGT · Magistrate Judge Alex G. Tse

First filed

The claim
Max 5x and Max 20x are sold as 5x or 20x Pro usage. The suit says that multiplier applies only within each 5-hour session while weekly limits cap the total, so subscribers get much less. The first complaint estimates Max 20x gives about 6–8× Pro and Max 5x about 3.5×, and calls the “50% savings” claim for Max 20x false.
Legal claims
California consumer law (CLRA, False Advertising Law, Unfair Competition Law), negligent misrepresentation, breach of contract and breach of the implied covenant. Consolidated with Smith v. Anthropic.
Anthropic
Moved to dismiss on 2026-09-22. It says it promised 5x/20x usage per session, disclosed that weekly limits apply and may change, and that no reasonable buyer was misled. It asks for dismissal with prejudice.
Status
Fully briefed: opposition filed 2026-10-06, reply 2026-10-20. Hearing on the motion set for 2026-11-06.

In re Claude Service Degradation Litigation

N.D. Cal. · No. 3:26-cv-07699-RFL · Judge Rita F. Lin

First filed

The claim
From 2026-03-04 to 2026-05-06, the suit says changes and bugs made paid limits run out faster and Claude worse: a lower default effort setting, smaller session limits at peak hours, and a caching bug. Anthropic kept charging full price without pro-rata credit.
Legal claims
UCL, False Advertising Law, CLRA, breach of contract, the implied covenant and unjust enrichment. Proposed class: US Pro, Max 5x and Max 20x subscribers who bought directly from Anthropic.
Anthropic
Its 2026-04-23 postmortem traced quality reports to three changes, said a bug likely drained limits faster, reset usage limits for all subscribers and said “we never intentionally degrade our models.” It moved to dismiss on 2026-10-14; that filing isn't public yet.
Status
Plaintiffs' response to the motion is due around 2026-11-13. First case management conference 2026-11-04.

On 2026-08-12 the court ruled the two cases are not related, so they move on separate tracks before different judges.

What it means for you

  • Nothing changes for now. Your limits are what Anthropic publishes today: Claude plan limits.
  • If a class is certified or a settlement is reached, the court orders formal notice to class members. You don't need to do anything to stay eligible.
